Cars or trucks that are going too fast can’t stop completely at red lights, and these drivers rarely take the time to look out their windows and make sure the way is clear before attempting a right turn or crossing an intersection.

What If They Say I Was to Blame?

Almost three-fourths of all pedestrian accidents in the United States happen at night or dusk. Yes, it can be harder to see you at these times, but the driver cannot claim you were negligent by failing to carry a flashlight or wearing reflective clothing. It would be a good idea, certainly; but there’s no legal uniform for pedestrians. Drivers must stop fully and ascertain that their path is clear before proceeding. If they can’t see, they can’t go.

But what if you did not cross the street at a designated crosswalk or intersection? What if there was no sidewalk, and you were walking on the shoulder and facing traffic? In that case, a legal concept called “comparative negligence” would come into play. In California, any money you can get from a personal injury lawsuit will be reduced by your percentage of fault. For example, if you crossed as the “walk” light was flashing red and were knocked down by a car sneaking through the intersection, a jury might find that you were 10% to blame for your injuries. However, the driver is still 90% at fault, and would owe you 90% of whatever amount the jury had decided was fair.
