You remain owner and retain control of all your assets. The trust can provide for surviving spouses and children, deferring all taxes that may be owed until after the death of the survivor. Proper trust planning can save substantial estate taxes. A trust is not an instruction to the Court, instead it is an instruction to the person you appoint as trustee. No probate is necessary.
